Who should apply for a cannabis license?

You can apply for a cannabis license if you are:

  • Cultivating (you grow cannabis products)
  • Producing (you produce cannabis products)
  • Packaging (you package cannabis products)

On the other hand, you don’t have to apply for a license in any of the following situations:

  • You don’t need to apply for a license to grow cannabis for personal use in accordance with the Cannabis Act.
  • If you are producing cannabis products for your own medical purposes, you don’t have to apply for a license in Canada.
  • If you are a person who is authorized to produce cannabis products for the medical purpose of another individual under the Cannabis Act, you don’t need a license.
  • But if you have a Health Canada license, you need to apply for a CRA cannabis license to produce cannabis products for both non-medical and medical purposes.

Personal cultivation

The most important thing to keep in mind is that plants cannot be located in the front or side yard setback areas as well as cannot be visible from public streets and walkways. In multi-family units, outdoor growing is not allowed.

You can only grow in an accessory structure, like a greenhouse, garage, etc. Growing inside a residential building is not allowed. The structure cannot be in the front or side yard setback areas. The greenhouse should be screened from public streets or walkways.

How long is the cannabis license valid?

Your license is valid for a maximum of 2 years. Your license will not be automatically renewed. You must apply for a license renewal no later than 30 days before the expiration date of your current license in order to renew your license. You must continue to fulfill the requirements of the license during the period you are licensed.
